*The courts in a Habeas Corpus proceeding of this kind, where the prisoner is arrested for extradition, cannot go into a trial of the merits of the cause. The proceeding is only an initiatory step to a trial in another State. As to the guilt
of the prisoner, they are not allowed to inquire. Their
judicial powers are limited to a determination on the
sufficiency of the papers and the identity of the prisoner. If the prisoner is discharged, it will not absolve him from being
re-arrested on a new warrant issued by the Governor. x X

With reference to the following cases the remarks, on pages one and two supra, with regard to res adjudicata and the system of federal jurisprudence should also be borne in mind.
One Bassing was extradited from Rhode Island to lew York in Larch, 1907, for grand larceny, where arraigned and after one or two adjourn- -ments the complaint was dismissed on motion of the State for lack of proof to convict. He returned to Rhode Island without objection on the part of the State of New York. In July, 1907, another warrant of extradition was issued against him and he sued out a writ of Habeas Corpus alleging the above facts and that he was not a fugitive, having returned with the knowledge and consent of the State of New York.
Justice Harlas said:-
"The question arises on these facts whether the Governor of
Rhode Island was authorised by the Constitution and laws of the United States to issue a second warrant for the arrest of Bassing and his delivery to the agent of Hew York, such warrant being based upon a second indictment for the same offence as that charged in the former indictment. We have
